Hillsborough Clerk Pat Frank sues daughter in trade dispute
TAMPA – Hillsborough Circuit Court clerk Pat Frank is suing his daughter over a business dispute over the family’s property management company.
In a circuit court lawsuit filed last month, Frank alleges that his daughter, Hillary Frank Aubin, 63, failed to turn over company records and other property after Frank said she did. had fired as a director of Collier Enterprises LLC in May.
Frank formed the company in 2005 with his eldest daughter, Stacy Frank, who died in 2016. Stacy Frank had been a managing member of Collier Enterprises, which has a shopping center at 3841 W Kennedy Blvd. in Tampa. Aubin became part of the business through her late sister’s estate, according to the lawsuit.
Aubin is not a member of the company, says the lawsuit, leaving Frank as the exclusive authority of the company “with the rights to participate in the management and conduct of the business and affairs of the company, and had the right to participate in the management and conduct of the business and affairs of the company. exclusive power to remove and replace the director of the company. “
Aubin disagrees with Frank and maintains that she is a member of the company, according to the lawsuit.
Aubin is listed as the sole manager of Collier Enterprises in company files filed with the Florida Secretary of State’s office from 2017 through early this year. An amended file in June identified Frank as the manager.
Aubin had been running the business of the company since 2016, but Frank said in the lawsuit that she “did not receive a single distribution even though there was more than enough money to make distributions.
“In addition, since Ms. Aubin assumed the post of director in 2016, she has mostly ignored or refused to honor Mr. Frank’s multiple requests regarding the company’s records and financial statements,” the lawsuit said.
Frank ended Aubin’s role in May, according to the lawsuit, and Aubin refused to hand over financial records and other documents to Frank, leaving her unable to run the business.
Specifically, the lawsuit states that “prior to Stacy C. Frank’s death, the company may have refinanced the debt on the property and used part of the proceeds to loan Stacy $ 300,000. C. Frank for use in other business activities. ” Frank said she had not received any information or documentation about the potential loan.
Frank and Aubin both declined to comment on the lawsuit.
Frank, 90, is nearing the end of his fourth term as Hillsborough Circuit Court clerk and has not sought re-election in 2020.
